Terms of Service
These Terms of Service govern your access to and use of AlphaCommerce. By using the service, you agree to these terms.

Acceptance of terms
By accessing or using AlphaCommerce or installing the plugin, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
Description of service
AlphaCommerce provides a WordPress plugin and cloud service that captures carts, displays revenue at risk, and enables recovery emails when you choose to activate recovery.
Authorization to act on your behalf
You represent that you own or control the store and are authorized to enable automated recovery messaging. You authorize AlphaCommerce to access, store, and process cart, order, and customer data necessary to provide the service and to send messages on your behalf as configured.
Email compliance responsibility
You are responsible for complying with applicable laws and regulations (including CAN-SPAM, GDPR/UK GDPR, CASL, and similar laws) and for ensuring you have a lawful basis to send recovery emails. You are responsible for your policies and practices, including unsubscribe and opt-out handling as required by law. AlphaCommerce provides tooling, not legal advice.
Sending infrastructure and deliverability
Recovery emails are sent through AlphaCommerce’s sending infrastructure (including Postmark) on your behalf, using your store name and reply-to settings. Deliverability and inbox placement are not guaranteed; we use commercially reasonable efforts to deliver messages. You are responsible for your content, offers, and brand usage, and we may enforce anti-abuse rules.
Acceptable use and anti-spam
You agree not to use AlphaCommerce for spam, purchased lists, deceptive content, or unlawful activity. We may suspend or terminate sending for high complaint rates, unusually high bounce rates, policy violations, or abuse. See our Acceptable Use Policy.
Rate limits and fair use
We may throttle, rate-limit, or cap sending or automation volume to protect deliverability and system stability. We may enforce limits without prior notice in emergencies.
Data processing and privacy
We process store identifiers, cart contents, customer email, order data/status, recovery events, and plugin telemetry to provide the service. You control the customer relationship and determine when recovery is activated. We retain data while your account is active and for a limited period after cancellation (typically 30 days); some operational logs may be retained longer (up to 90 days) for deliverability, security, and compliance. We use reasonable security measures but cannot guarantee absolute security. See our Privacy Policy.
Subprocessors
We use trusted subprocessors to deliver the service, including Postmark (email delivery), Stripe (billing), Supabase (data storage and authentication), and Vercel (hosting). Our subprocessors may change over time and are reflected in the Privacy Policy.
Billing, cancellation, and refunds
Subscriptions are billed monthly through Stripe. Cancellation stops renewal at the end of the current billing period. Fees are non-refundable except as required by law. Inactive subscriptions will not send recovery emails.
Disclaimers, limitation of liability, and indemnity
The service is provided “as is” and “as available.” We do not guarantee recovered revenue or deliverability. To the maximum extent permitted by law, AlphaCommerce is not liable for indirect, incidental, or consequential damages, or for lost profits or revenue. Our total liability is limited to fees paid to AlphaCommerce in the previous three months. You agree to indemnify AlphaCommerce for claims arising from your products, marketing claims, content, or unlawful emailing.
Termination and suspension
We may suspend or terminate access or sending for violations, abuse, or non-payment. Upon termination, we will handle data as described in the Privacy Policy and retention section above.
Changes
We may update the service or these terms from time to time. The effective date will be shown at the top. Continued use of the service means you accept the updated terms.
Governing law
These terms are governed by the laws of the jurisdiction where AlphaCommerce is established, without regard to conflict of laws rules.
